James Stephens Jewellers (“James Stephens Jewellers”, “we” or “us”) offer a variety of services to customers (“customer” or “you”) including jewellery and watch repair, restoration, cleaning, alterations and bespoke jewellery design, and jewellery sales (the “Services”). The following terms and conditions (the “Terms”) set out the agreement we have with you to govern our provision of the Services. By entering into an agreement for Services with us, you are deemed to accept these Terms.
Repairs
We offer a variety of jewellery repairs, remodelling and renovation services (“the Repairs”). Although we will use our best efforts to assist customers with any queries, we may not be able to repair everything. We reserve the right to turn away items that our workshop team do not feel comfortable working on. Furthermore, we are unable to perform repairs on items made of base (non-precious) metal unless otherwise agreed in our discretion and on a case-by-case basis.
We will provide an initial estimate for repair on receipt of your item (the “Estimate”), which is understood as accepted when you leave the aforementioned item with us. Customer understands that difficulties encountered during a Repair due to the condition and/or age of the item may lead to the Estimate being revised. In this case, you may decide not to go ahead with the work and the item will be returned to you; however, depending on the extent of investigations required, there may be a charge payable to cover labour and materials.
Once we start work on a Repair, any changes requested by a customer will be subject to further charges. Customers may not cancel a repair once work has started on it by us and may still be liable to pay the full Estimate even if the work has not been completed.
James Stephens Jewellers reserves the right to subcontract any or all parts of a Repair at its discretion. Where we have provided a timeframe for a Repair, customer understands and agrees that this is only an estimated timeframe. We will do our best to keep you informed regarding Repair progress; however, we cannot be held responsible for any delays or extension due to circumstances or events outside of our control.
When a ring is being sized, we will make our best efforts to preserve any engravings or hallmarks, however, we accept no liability for damage to engravings or hallmarks where resizing or altering rings.
Customer understands that there is an element of risk to all Repairs, as heat will be applied to your item in order to undertake a Repair. If a piece of metal is faulty then the heat may further damage the piece beyond repair. Whilst we will always try to identify faulty metal before work is carried out, sometimes it is not possible as the fault may be on the inside of the metal and be undetectable until heat is applied.
We accept no liability if damage occurs due to faulty metal. In this case we recommend that the customer should contact the original retailer for replacement or refund. Furthermore, there are times where parts and materials may break or fail during normal repair due to wear and tear. We cannot accept liability for such breakages as they are beyond our control and could not be reasonably foreseen; however, we will use all reasonable efforts to avoid this where possible.
If an item is received which has previously been reported as stolen, James Stephens Jewellers reserves the right to inform the former owner and/or the relevant authorities who alone would have the authority to determine legal ownership of the item in question, unless a mutual agreement is reached between the former owner and the current owner, and to keep the item in custody until ownership is determined.
You accept that you must reasonably inspect your Repair upon collection to ensure that you are satisfied with the repair completed and the condition of your item. We cannot be held responsible for any subsequent damage that occurs once your item has left our care and do not offer set guarantees. We may agree to reperform a Repair at no cost at our discretion and will assess items on a case-by-case basis.
We assume no responsibility for items not claimed within six (6) months following the completion of the Repair, and you acknowledge and agree that items not claimed within this timeframe may at our discretion be disposed of or sold without liability to the customer.
Returns
Any returns of repaired items or items purchased in the shop will be subject to our returns policy available HERE.
Data Processing
We may ask for your personal information such as name or phone number when taking in a Repair so that we can contact you on completion of the work. We will process all personal data in accordance with our privacy policy which can be found HERE.
General
To the extent that any of the terms included in these Terms are deemed illegal or invalid, they shall be deemed severed from this agreement and the enforceability of the remaining terms shall be unaffected.
The failure of a party to exercise its rights under this agreement shall not be deemed a waiver of such right unless otherwise expressly agreed in writing.
No amendment of these Terms shall be valid unless it is in writing and signed by both parties.
In the case of our failure or delay to perform this Agreement due to any force majeure event, we shall not be liable for such failure or delay. In the case of failure to perform any part of this Agreement due to any force majeure event, the James Stephens Jewellers may be exempted from corresponding liability to the extent of the impact of such event. However, we shall continue to perform other obligations under the Terms which have not been affected by such force majeure.
These Terms shall be subject to the law of England and Wales. The parties agree that any dispute arising out of these Terms shall be resolved in the courts of England.
